February 2012 Review Results

  1. Review of Compliance
    • HEOA compliance web page is in place; it will need revision to document procedural changes
    • Link to Educause list, continually updated, of legal alternatives, was added to the main HEOA page for easier reference
    • Review results are published on UVM's HEOA compliance page
    • Information about policies, sanctions, and penalties is available to both enrolled and prospective students
    • When registering for the wired network, and when activating a NetID, one is presented with a summary of acceptable uses, including a notice that "unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may subject Users to University disciplinary action and civil and criminal liabilities." This message is also included in the email to each individual who has activated a NetID.
    • CSES presentations to campus groups to discuss policies include copyright infringement as part of the material, explaining both what not to do and what is legal.
    • UVM has a vigorous program of accepting and responding to copyright infringement notices.
  2. Over the past year, the trend is toward more infringement complaints per person, but involving fewer people overall. The availability of wireless networking throughout the residence halls has made identification more difficult and has curtailed the ability to get attention by cutting off Internet service (that still is an option for wired connections, but wireless is much more widely used). Locking a NetID is not a good option; locking at certain times of day was discussed but would be a manual process.

UVM is developing a more automated system for processing complaints and notifying alleged infringers. That system will be tested and implemented during the spring semester.

    • It will only be able to process complaints in standard XML format; we will work with complainants who send nonconforming XML.
    • Complaints will trigger an email to alleged infringers (unless the software can't determine whom to notify).
    • The email will contain language much like what's currently used and will require recipients to go to a web page to acknowledge or deny the infringement. The system will track responses.
    • CSES will use a periodic report of alleged infringers and their responses (or nonresponses) to determine the most appropriate action, including possible sanctions, in each case.

August 2011 Review Results

  1. Review of Compliance
    • HEOA compliance web page in place
    • Link to Educause list, continually updated, of legal alternatives
    • Review results are published on UVM's HEOA compliance page
    • Student email went to all UVM students Jan., Sept., May; all faculty & staff; September mailing will need to be updated with new Compliance URL (Compliance will put a redirect in place for old URL)
    • Information about policies, sanctions, and penalties is available to both enrolled and prospective students
    • When registering for the wired network, and when activating a NetID, one is presented with a summary of acceptable uses, including a notice that "unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may subject Users to University disciplinary action and to civil and criminal liabilities." This message is also included in the email to each individual who has activated a NetID.
    • CSES presentations to campus groups to discuss policies include copyright infringement as part of the material, explaining both what not to do and what is legal.
  2. Over the past year, no noticeable trends; variations by time of year but not so much year-to-year; dependent upon music industry initiative

The charts below show P2P copyright complaints received and processed between January 2009 and May 2011.

Graph of Copyright Complaints by Month, January 2009 to May 2011

    • Agreed that we should document on web page ways students are informed about P2P and have indicated their compliance (email each semester, account initiation), and this has been completed
    • Referred 310 students to CSES; generally, we have locked out their access to the network by the time they're referred to CSES
    • We believe that few students are repeat offenders: once they've gotten to the CSES stage, they don't repeat the offense, so the progressive discipline method is effective
