I Heard About an AGO Settlement...

Unclaimed Funds 

Most often when settlement funds cannot be paid to an individual, the funds are submitted to the Office of the State Treasurer for the State of Vermont Unclaimed Property Division.  If you believe you have funds that were not issued to you, you can check the list at any time, using their  Unclaimed Property Owner Search.

Often consumer protection settlements by the Vermont Attorney General's Office include consumer restitution.  Please see below for more detailed information and instructions for the settlements listed below

Literati Creative Group (Vermont Vows and Well Wed)  Settlement

The owner of Literati lacked sufficient funds to provide reimbursement, but must reimburse $17,000 if she demonstrates ability to pay within the next five years. The owner is prohibited from starting a new publication for the next five years without posting a bond. Press Release (07/03/2017).

Ship Sevin Settlement

Sevin has hired a Third-Party Administrator, Claire Welkar (802) 777-7555, to determine the refund amounts owed to all former and current tenants of Ship Sevin, to vacate any evictions where illegal fees were included with nonpayment of rent, and to notify the public housing authorities if vouchers were terminated on that basis so occupants may request having their vouchers restored.  Press Release (06/30/2017).

Provigil Multistate Settlement

Consumers who purchased the drug and generic versions of the product between June 24, 2006 and March 31, 2012 may be entitled to a payment from the Settlement Fund.  The court extended the time to file claims on the settlement to June 25, 2017.  For more information or to obtain a claim form, visit www.StateAGProvigilSettlement.com or call 877-236-1413.  Press Release (04/142017).

Western Union Multistate Settlement

If you have lost money to a scam involving a Western Union money transfer 1/1/2004 through 1/19/2017, you may be able to get a refund.  The U.S. Dept. of Justice is developing the refund program.  As of June 30, 2017, the claims process has not started.  If you think that you may be eligible check the refund program site often.  Please advise our office if you believe you are eligible for a refund via our online complaint form. Press Release (1/31/2017).

Osterman Propane Settlement

Within 30 days, company will send consumers a check with an explanatory letter in an envelope from the Attorney General's Office.  For current customers, Osterman may mail a check or offer a credit to their account or a reduction of any account balance. Press Release (12/8/2016).

"Member Choice" Discount Travel Club Operator and Marketers Settlement

Consumers who purchased the travel club memberships will receive checks in the mail providing partial restitition for the cost of the membership purchases. Press Release (11/22/2016).  In order to seek additional restitution, a lawsuit has been filed against Adrian Miller and his companies: Travel Supplier of America, Start 2 Finish Travel Management, and Universal Concepts Inc.

United Advisors Group Student Loan Debt Consolidator Settlement

Each consumer who paid for services will receive checks sent from the Office of the Attorney General after 30 days of the effective date. Press Release (11/18/2016).

Provigil Antitrust Settlement

Under the terms of the settlement, consumers will receive notice and an opportunity to participate in, object to, or opt out of settlement. Press Release (8/4/2016).

Volkswagen Partial Settlement RE: VW and Audi 2.0-Liter Diesel Vehicles

VT consumers who own or lease certain Volkswagen and Audi 2.0-liter diesel vehicles model years from 2009-2015 will receive a cash payment from Volkswagen and will have the option of having their vehicle modified or repurchased by Volkswagen under the terms of the settlement.  Note: This is a partial settlement that addresses only the 2.0-liter diesel vehicles; the 3.0-liter engines and CPA/state environmental penalties are not included in this agreement.  Press Release (6/28/2016).

Attorney General and Class Apple E-Book Settlement

Consumers who purchased one or more E-books from April 1, 2010 through May 21, 2012 that were published by any of the settling publishers may receive payment from the Apple Settlement. Issuance of credits and/or checks from Apple will begin June 21, 2016.  Amazon, Barnes & Noble, and Kobo customers will receive an email informing them that there is a credit in their account. Apple customers will receive an email from a third party vendor from "e-books Settlement Administrator" (ebookssettlement@qgemail.com).  Sony customers will automatically receive a check in the mail.  Eligible Google customers will receive a check if they previously filed a claim in the settlement.  Customers will receive $6.93 per New York Times Bestseller and $1.57 per other book. FAQsNotice.

Billing Tree, Inc. Settlement

Under the terms of the settlement, Billing Tree shall attempt to credit each eligible consumer's bank account within 15 days of the settlement.  The transaction will likely appear with the lender's name and "VTsettlement refund" in the transaction note.  For related lender information, see Exhibit A of the settlement document.  Press Release (5/20/2016).

Haskins Gas Service Settlement

Within 30 days, Haskins will pay $475 in restitution by check to each of the 96 Vermont consumers of the settlement.  The settlement settles claims that the company violated Vermont consumer protection laws, regarding failure to remove propane tanks and issue refund checks within time frames required by Vermont law.  Press Release (5/2/2016).

Rymes Propane Settlement

Within 30 days, Rymes will mail a refund check to 327 consumers who either experienced improperly collected fees, or excessive finance charges.  Press Release (3/10/2016).

MoneyGram Settlement

Within the next 90 days, eligible Vermont consumers will receive a notice mailed from a settlement administrator with instructions on how to claim their restitution payment.  Consumers may be eligible to receive restitution if they previously filed a complaint with MoneyGram about a transaction which involved a fraud induced wire transfer and the money transfer was sent through a MoneyGram agent based in the United States to a payee located in a foreign country (other than Canada) between July 1, 2008 and August 31, 2009.  For more information about the settlement, visit the FAQ's page and go to the Settlement Administrator's website www.MoneyGramSettlement.com.  Press Release (2/12/2016).

HSBC Settlement

Approximately 25 Vermonters who lost their homes due to foreclosure by HSBC between 2008 and 2012 may be eligible for a settlement payment estimated to be at least $1000. HSBC or the settlement administrator will contact any potentially eligible Vermonters. Approximately 400 Vermont homeowners whose loans are serviced by HSBC may be eligible to receive additional assistance under the settlement agreement in the form of loan modifications, loan refinancing, principal forgiveness, or other relief. Homeowners whose mortgage is serviced by HSBC Bank USA NA may contact 1-866-435-7085 or their Case Manager for assistance. Homeowners whose loans are serviced by HSBC Mortgage Services, HSBC Household Finance, or HSBC Beneficial may contact 1-800-333-7023 or their single point of contact for assistance.  Press Release (2/5/2016).

Education Management Corporation Settlement

EDMC to forgive $60,000 in student loan debt* to 67 Vermonters that are Qualifying Former Students.  Within 90 days of the effective date, qualifying students will be sent a letter by EDMC to notify of forgiveness of the institutional debt.  Press Release (11/16/2015).
*Debts owed to non-EDMC entities are not included, such as federal student loans owed to the US government.

Suburban Propane Settlement

1830 consumers will receive refund to resolve actual or potential delay in propane service termination between January 1, 2010 and April 13, 2012.  593 consumers will receive a refund for improperly charged regulatory fees.  Consumers who qualify for restitution under the settlement will be mailed a check within 60 days of 10/22/15.  Consumers who believe they should qualify based on the terms of the settlement, but did not receive a check, can file a complaint with the Consumer Assistance Program.  Press Release (10/23/2015).

Internet Order, LLC (aka Pimsleur and Stroll Language) - Pennsylvania Settlement

The Pennsylvania Attorney General's Office Settlement includes restitution for claimants anywhere in the country.  Consumers who were charged by one of the Internet Order companies for CDs under their negative option plan after January 1, 2009 may receive a refund for those purchases if they file a complaint with the PA Attorney General's Office by calling 1-800-441-2555 or by completing their complaint form.  Complaints must be received by the PA AGO by October 30, 2015. 

Manor Resources, LLC (Turbo Title Loans) Settlement

Five consumers will be contacted directly within 60 days of the settlement, and refunded a total of $16,043.  Press Release (9/23/2015).

Bank of America (BOA) Settlement

A $250,000 restitution fund will be created to compensate Vermont homeowners who establish that BOA failed to honor the terms of their settlement agreement. Consumers may be eligible if all of the following criteria are met: 1) they were a defendant in a foreclosure action brought by BOA, 2) they resolved that foreclosure action through a settlement agreement, and 3) on or after April 4, 2012, BOA violated the terms of the settlement agreement.  Consumers can submit claims by completing the claims form (available as "PDF" or "Word" document) and submitting it to the Attorney General's Office by September 8, 2015.  Press Release (7/10/2015).  $190,000 Remaining Settlement Fund Distributed to VT Legal Aid and State Judiciary to Assist with Foreclosures in VT.

Chase Settlement

Consumers who qualify for restitution under the settlement due to overpayment of debts will be contacted directly by Chase.  Press Release (7/8/2015).

Classmates.com Settlement

Consumers seeking restitution under the terms of the Classmates.com settlement, must submit complaints through the Consumer Assistance Program's Online Complaint Form. Consumers must provide their full name, contact information, and an explanation of why they feel they are entitled to a refund.  Forms should be submitted as soon as possible as the forms must be sent by the Consumer Assistance Program office to Classmates.com by August 31, 2015.  Press Release (5/26/2015).

Sprint Cramming Settlement

Consumers can submit claims under the redress program here by December 31, 2015.  To obtain a claim form that can be mailed, please follow the instructions of the settlement administrator.   Press Release (5/12/2015).

Verizon Cramming Settlement

Consumers can submit claims under the redress program here by December 31, 2015.  To obtain a claim form that can be mailed, please follow the instructions of the settlement administrator.   Press Release (5/12/2015).

McGregor's Pharmacy Settlement

Former McGregor's consumers who may have been charged improper service fees or copayments from January 2004 through December 2012 who qualify under the settlement will be mailed a check directly.  Press Release (4/24/2015).  Original Press Release.

SunTrust Bank Settlement

Consumers eligible under this settlement will be contacted by the settlement administrator in March 2015.  

T-Mobile Cramming Settlement

Sirius XM Settlement

Consumers must complete the form and submit it to SiriusXM, PO Box 33059, Detroit, MI 48232-5059 by May 1, 2015.  More information.  Press Release (12/4/2014). 

A-1 Premium Budget, Inc. Settlement

Consumers that are party to the settlement will be contacted directly and issued refund checks.  Press Release (12/4/2014)  

Stonebridge Benefit Services and J.C. Penney Co. Settlement

Card charges occurring pre-May 8, 2012 can be disputed by submitting a written complaint by December 31, 2014.  See instructions. Charges occurring after May date will be issued refund checks.  Press Release (11/25/2014)

Active Network/Active.com/Active Advantage Settlement

Consumers entitled to a refund will receive an email and must respond with their name, and the mailing address of where they would like the check to be sent by the deadline specified in the email.  Press Release (11/24/2014)

Buck's Furniture Settlement

Consumers that have submitted complaints to CAP or directly to Buck's should receive a $100.00 restitution check in the mail.  Press Release (11/5/2014)

Green Tree Servicing Settlement

Consumers entitled to a refund will be contacted directly and issued refund checks.  Press Release (10/30/2014)

AT&T Cramming Settlement

Intercept Corporation Settlement

A $74.78 credit payment will be issued directly to consumer bank accounts.  Press Release (10/2/2014)

Merchant Processing Solutions Settlement

Twenty Vermont business consumers will benefit and by October 1, 2014 will be repaid all amounts it paid above one percent for processing, or above the contracted-for basic monthly equipment lease fee.  Press Release (9/10/2014).

Unlicensed Lender Settlements

A number of unlicensed lenders settled with the Attorney General's Office, including A-1 Premium Budget, Inc. aka "Cash in a Wink", CashCure, LLC, CashCall, Inc. & Western Sky, et al., Government Employees Credit Center, Inc., Sure Advance, LLC, T Money, LLC, Intercept Corporation, many of which resulted in consumer restitution.
