Judicial Procedures from the Student Activities Committee

If a University recognized club breaks Article VII in the SGA Constitution, the appropriate course of action will be determined by the Student Activities Committee (SAC). The chosen course of action depends on the severity of the infraction as determined by SAC. These three actions are:

1) Handling the situation within the SAC.

2) Referring the club's infraction to an ad-hoc committee assembled by the SAC.

3) Referring the club's infraction directly to UVM Police Services.

If a minor infraction such as the failure of a club to submit required forms is committed by a club, there are three progressively harsher steps that will be taken against said club.

1) Upon the first minor infraction, the club president will receive an e-mail, a phone call, and a recommendation to meet with the SAC.

2) Upon the second consecutive infraction, the SAC will recommend that the SGA freeze the club's budget and no longer officially recognize it as University sponsored club. The respective president must be advised of this action prior to the meeting when it is to be recommended.

3) If the required actions are not submitted within two weeks after the aforementioned action, the club will be derecognized.

If a more severe infraction is committed by a club, the SAC will recommend that said club meet with an ad-hoc committee. The ad-hoc committee will be composed of one senator from each committee, as appointed by the committee chair. The SGA Executive Committee will designate one member from the ad-hoc committee as the chairperson. The ad-hoc judicial committee will have two weeks to investigate the actions of the club and recommend appropriate penalties for the club to the SAC. During the two week investigation, the ad-hoc committee will meet with the members of the SAC and the officers of the club in question at least once. If deemed necessary, the advisor of the SGA will serve as a counselor to the ad-hoc committee. Upon receipt of the recommendation from the ad-hoc committee, the SAC has three possible courses of action. They may:

1) Accept the recommendation as presented by the ad-hoc committee and present it to the SGA.

2) Make amendments to the recommendation and present the modified course of action to the SGA.

3) Determine that more investigation is needed before making a decision in regard to possible penalties for the offending club.

If a committed infraction is deemed "very severe" by the SAC, it will be referred directly to UVM Police Services. Pending the results of their investigation, the club will be placed on probation and its budget will be frozen. Depending upon the results of the investigation, the club may face sanctions, derecognition, or dismissal by the University.
