Alcohol & Other Drug Violations

The University of Vermont is committed to the health, safety and success of all students. One of the challenges students can face is the use and/or abuse of alcohol and other drugs.

To address this challenge and support our students in their educational and personal goals, the Center for Student Ethics and Standards holds students accountable for behavior that violates university policies, especially behavior that may cause harm to an individual student or to others.

If a student is found responsible for violating Health and Safety Standards (on campus) or the University's Alcohol & Other Drug Policy, the interventions and sanctions outlined below will be imposed. The overall goals of these interventions and sanctions are to:

  1. Deter students from engaging in unhealthy and/or harmful behaviors.
  2. Educate students about how their choices may negatively impact themselves and others.
  3. Motivate students to change their behavior so that they can contribute to a healthy and safe community, and optimize their academic success.
  4. Temporarily or permanently remove students who continually and/or significantly disrupt the residential community and learning environment.

NOTIFICATIONS: If a student is found responsible for violating the Alcohol & Other Drug Policy, the student's academic college dean's office will be notified.

Additionally, parents/guardians of students under the age of 21 will be notified when the student is found responsible for violating the Alcohol & Other Drug Policy.

Health and Safety Infractions (on campus)

POSSESSION OF EMPTY ALCOHOL CONTAINERS OR MARIJUANA PARAPHERNALIA

Follow-up:

  • Meeting with Residential Life staff
  • Health and Safety Infraction Fee ($150.00/person per incident)

Alcohol Violation Sanction Guidelines

PLEASE NOTE: The following interventions and sanctions may vary based on the circumstances and severity of the incident, and the student's conduct history.

POSSESSION OR CONSUMPTION WITH MINIMAL DISRUPTION

  • First Alcohol possession/consumption OR
  • First Common Source (12 or more servings of alcohol), OR
  • Third Health and Safety Infraction (empty alcohol containers)
Sanctions:
  • Establish a Conduct Record
  • Completion of the AlcoholEdu for Sanctions Program
  • Common Source Fine ($250 Fine/ person when applicable)
CONCERNING OR DISRUPTIVE INCIDENT(S)
  • Second Alcohol possession/consumption, OR
  • Second Common Source (12 or more servings of alcohol), OR
  • First Detox, OR
  • First alcohol incident involving disruption (e.g., excessive noise, trash, involved in physical altercation, etc.)
Sanctions:
  • Completion of a mandated educational or reflective project/meeting
  • $250 Fine for any Common Source violation
  • Community restoration/restitution (when applicable)
  • Disciplinary Probation* for duration of enrollment at UVM
PERSISTENT CONCERNING BEHAVIOR OR SINGLE SERIOUS INCIDENT
  • Three or more Alcohol possession/consumption, OR
  • Two or more Detoxes, OR
  • Two or more alcohol incidents involving disruption (e.g. excessive noise, trash, involved in physical altercation) OR
  • First time Serious Incident (e.g. police involvement, DUI, etc.)
Sanctions:
  • Review for suspension from the University of Vermont
  • Consideration for deferred suspension program
EGREGIOUS VIOLATIONS
  • Alcohol possession/consumption combined with egregious behavior (e.g. physical assault, sexual assault, significant vandalism, destruction of property, attempts or threats of severe harm, etc.), OR
  • Third Detox
Sanctions:
  • Review for permanent dismissal from the University of Vermont

Drug Violation Sanction Guidelines

POSSESSION OR CONSUMPTION WITH MINIMAL DISRUPTION
  • First Marijuana possession/use, OR
  • Second or more Health and Safety Infraction (Drug Paraphernalia)
Sanctions:
  • Establish a Conduct Record
  • Educational sanction
  • $150 Fine
CONCERNING OR DISRUPTIVE INCIDENT(S)
  • Second Marijuana possession/consumption, OR
  • First Detox (drugs), OR
  • First Narcotic, Opiate, or Unauthorized Prescription Drug Use
Sanctions:
  • Completion of a mandated educational or reflective project/meeting
  • Substance Abuse Assessment (1st detox or 1st Narcotic, Opiate, or Unauthorized Prescription Drug Use)
  • Disciplinary Probation* for duration of enrollment at UVM
  • $250 Fine
PERSISTENT CONCERNING BEHAVIOR OR SINGLE SERIOUS INCIDENT
  • Three or more Marijuana possession/use/paraphernalia OR
  • Second or more Narcotic, Opiate, or Unauthorized Prescription drug incidents, OR
  • Second Detox (drugs) ,OR
  • Possession of controlled substance in large amount
Sanctions:
  • Review for suspension from the University of Vermont
  • Consideration for deferred suspension program
EGREGIOUS VIOLATIONS
  • Drug Sales/Distribution, OR
  • Narcotic, Opiate, or Unauthorized Prescription Drug Use with aggravating factor (e.g. physical assault/altercation, significant vandalism, destruction of property, attempts or threats of severe harm)
Sanctions:
  • Review for permanent dismissal from the University of Vermont

*Disciplinary Probation is defined as: The next recommended sanction is suspension, and future violations may revoke study abroad, alter future on campus housing assignment, or impact involvement in other university sponsored activities.

NOTE: First detox, Second alcohol, and Second marijuana violations may be referred for an AOD evaluation in the local community at the student's expense if they fail to complete assigned project/meeting.
